華為回應加司法部批準推進(jìn)引渡孟晚舟：感到失望

　　3月2日消息，據外媒報道，加拿大司法部長(cháng)當地時(shí)間3月1日決定就孟晚舟案簽發(fā)授權進(jìn)行令。

　　對此，華為發(fā)表聲明稱(chēng)，美國的指控是出于政治動(dòng)機。美國總統曾多次表示，如果孟女士案有助于美國與中國達成貿易協(xié)議，他會(huì )對此案進(jìn)行干預。在這種情況下，加拿大司法部長(cháng)仍然決定簽發(fā)授權推進(jìn)令，我們對此感到失望。美國指控的行為在加拿大根本不構成犯罪。盡管如此，加拿大司法部長(cháng)仍然同意簽發(fā)授權推進(jìn)令，這完全不符合“雙重犯罪”的基本引渡原則。

　　美國的指控是出于政治動(dòng)機。美國總統曾多次表示，如果孟女士案有助于美國與中國達成貿易協(xié)議，他會(huì )對此案進(jìn)行干預。在這種情況下，加拿大司法部長(cháng)仍然決定簽發(fā)授權推進(jìn)令，我們對此感到失望。

　　美國指控的行為在加拿大根本不構成犯罪。盡管如此，加拿大司法部長(cháng)仍然同意簽發(fā)授權推進(jìn)令，這完全不符合“雙重犯罪”的基本引渡原則。

　　孟女士沒(méi)有任何不當行為，美國對她的起訴與引渡是對司法程序的濫用。

　　希望孟女士的合法權利在引渡過(guò)程中的司法階段能得到保護。

　　1.We aredisappointed that the Minister of Justice has decided to issue an Authority toProceed in the face of the political nature of the U.S，charges and where thePresident of the United States has repeatedly stated that he would interfere in Ms.Meng‘s case if he thought it would assist the U.S negotiations with Chinaover a trade deal.

　　2.We are alsoconcerned that the Minister has approved an ATP in circumstances where theconduct alleged to be an offence in the U.S.would not be an offence inCanada. This is an affront to the foundational extradition principle ofdouble criminality.

　　3.Our clientmaintains that she is innocent of any wrongdoing and that the U.S.prosecutionand extradition constitutes an abuse of the processes of law.

　　4.Our client looksforward to having her rights vindicated in the judicial phase of theextradition process.

　　3月2日，中國駐加拿大使館發(fā)言人就加司法部就孟晚舟案簽發(fā)授權進(jìn)行令強勢回應：

　　中方對加拿大司法部就孟晚舟案簽發(fā)授權進(jìn)行令表示強烈不滿(mǎn)和堅決反對。孟晚舟案不是一起簡(jiǎn)單的司法案件，而是對一家中國高科技企業(yè)的政治迫害。后來(lái)的事態(tài)發(fā)展證明了這一點(diǎn)。加方盡管標榜“法治原則”、“司法獨立”，但并不能掩蓋其在孟晚舟案上犯下的錯誤。

　　從事件所呈現出的明顯的政治干預情況看，如果加方真的遵循法治原則、司法獨立，加方就應該按照加引渡法的有關(guān)條款，拒絕美方引渡請求，立即釋放孟晚舟女士。加法庭的最終審理結果將是對加方是否堅持司法獨立的試金石。我們將拭目以待。
